Terms of Service

These Terms of Service ("Terms") govern your use of the BlueGecko mobile application ("App") and website at bluegecko.app ("Site"), operated by Gecko Industries LLC ("we," "us," or "our"). By downloading, installing, or using BlueGecko, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use BlueGecko. If you are between 13 and 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

2. Description of Service

BlueGecko is a personal AI assistant that runs on your mobile device. It can access device features (with your permission) including text messages, email, calendar, contacts, and photos. The AI maintains persistent memory and a configurable personality. All AI data is stored locally on your device.

3. Account and Access

BlueGecko does not require a traditional account with a username and password. Your identity is tied to your device and your purchase records. You are responsible for maintaining the security of your device. We are not responsible for unauthorized access to your AI data resulting from a compromised device.

4. AI Credits and Purchases

4a. How Credits Work

BlueGecko uses an AI credit system. Credits are consumed when the AI processes your messages. Different AI models consume different amounts of credits depending on complexity. The App automatically routes between faster (cheaper) and more powerful (more expensive) models.

4b. Purchasing Credits

Credits can be purchased in packs through the App via Google Play or the Apple App Store. All in-app purchases are subject to the respective store's terms of service and refund policies. Prices may vary by region and are displayed in your local currency at the time of purchase.

4c. Credits Are Non-Transferable

Credits are tied to your device/account and cannot be transferred to another user. Unused credits do not expire.

4d. Refund Policy

Refunds for in-app purchases are handled by Google Play or the Apple App Store according to their respective refund policies. For founding member purchases made via the website (Stripe), refunds are available within 30 days of purchase if the App has not yet been used. After use, refunds are handled on a case-by-case basis. 5. Founding Member Terms

Founding Members pay a one-time fee of $19.99 (USD) and receive:

  • 1,000 starter AI credits (double the standard 500)
  • A permanent 50% bonus on all future credit pack purchases
  • "Founding Gecko" badge in the App
  • Early access to new features
  • Access to a private group chat with the founders
  • Name credit in the App
  • Voting rights on feature development

Founding Member status is limited to the first 200 purchasers. Benefits are non-transferable and tied to the purchasing account. The 50% credit bonus applies for the lifetime of the BlueGecko product. "Lifetime" means for as long as BlueGecko is actively maintained and operational.

6. Acceptable Use

You agree not to use BlueGecko to:

  • Violate any applicable laws or regulations
  • Generate, store, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate another person in a deceptive manner
  • Send spam, phishing, or unsolicited messages through the AI
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Circumvent any rate limiting, credit system, or access controls
  • Use the AI to generate content that infringes on others' intellectual property

We reserve the right to suspend or terminate access for violations of these terms.

7. AI Limitations and Disclaimer

BlueGecko uses artificial intelligence that may produce inaccurate, incomplete, misleading, or inappropriate responses. You acknowledge that:

  • AI outputs should not be relied upon as professional, legal, medical, financial, or safety advice
  • You are responsible for reviewing and approving any actions the AI takes on your behalf, including sending messages or managing emails
  • The AI may misinterpret context, tone, or intent in your messages or data
  • The AI's memory and personality systems are simulated and do not represent genuine consciousness or understanding

8. Device Permissions and Data Access

BlueGecko requests access to device features (SMS, email, calendar, contacts, photos) to provide its core functionality. All permissions are optional and can be revoked at any time through your device settings. You grant BlueGecko permission to access, process, and store the data from these features locally on your device for the purpose of providing AI assistant functionality. We do not access, collect, or store this data on our servers.

9. Intellectual Property

The BlueGecko name, logo, App, and all related content are the property of Gecko Industries LLC. You may not copy, modify, distribute, or create derivative works based on our App or content without our written permission. Content you create using the AI (your conversations, the AI's responses to your prompts) belongs to you.

10. Third-Party Services

BlueGecko integrates with third-party services including AI model providers (Anthropic/OpenRouter), payment processors (Google Play, Apple App Store, Stripe, Adapty), and email services (Gmail API). Your use of these services is subject to their respective terms. We are not responsible for the availability, accuracy, or conduct of third-party services.

11. Limitation of Liability

To the maximum extent permitted by law:

  • BlueGecko is provided "as is" and "as available" without warranties of any kind, express or implied
  • We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App
  • We are not liable for messages sent on your behalf by the AI, data accessed or misinterpreted by the AI, or decisions made based on AI recommendations
  • Our total aggregate liability is limited to the amount you have paid us in the 12 months preceding the claim

12. Indemnification

You agree to indemnify and hold harmless Gecko Industries LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of BlueGecko, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

You may stop using BlueGecko at any time by uninstalling the App. We may suspend or terminate your access if you violate these Terms. Upon termination, your on-device data remains on your device (we cannot remotely delete it). Any unused credits are forfeited upon termination for cause.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Continued use of BlueGecko after changes constitutes acceptance of the revised Terms. The "Last updated" date at the top reflects the most recent revision.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware.
